By accessing, browsing, or using Pixground in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, our Copyright Policy, and our Community Guidelines. If you do not agree to these Terms, you must not use the platform.

You must be at least 13 years old to use Pixground. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf. By using Pixground, you represent and warrant that you meet these eligibility requirements.

To access certain features such as uploading wallpapers, posting comments, and saving favorites, you must create an account. When you create an account:

• You agree to provide accurate, current, and complete information.

• You are responsible for maintaining the security of your account credentials.

• You are responsible for all activity that occurs under your account.

• You must notify us immediately if you suspect unauthorized access to your account.

• You may not create accounts for the purpose of violating these Terms or our Community Guidelines.

Pixground reserves the right to suspend or terminate accounts that violate these Terms.

Pixground allows registered users to upload wallpapers, write comments, and submit other content ("User Content"). By uploading or submitting User Content, you represent and warrant that:

• You own or have all necessary rights, licenses, and permissions to upload and share the content.

• Your content does not infringe the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party.

• Your content complies with our Community Guidelines and all applicable laws.

By uploading content to Pixground, you grant Pixground a non-exclusive, worldwide, royalty-free, transferable license to host, display, reproduce, distribute, modify (for formatting and optimization purposes only), and make available your content in connection with operating and promoting the platform. This license continues for as long as your content remains on the platform. You may remove your content at any time, which will terminate this license, except where the content has been shared or cached by third parties.

You retain all ownership rights in your original content. Pixground does not claim ownership of User Content.

Wallpapers available on Pixground are provided for personal, non-commercial use unless otherwise indicated by the creator. When you download a wallpaper:

• You may use it as a personal wallpaper or background on your own devices.

• You may not redistribute, resell, sublicense, or claim ownership of downloaded wallpapers.

• You may not use downloaded wallpapers in commercial products, merchandising, or advertising without explicit permission from the creator.

• You may not remove or alter any watermarks, metadata, or attribution present in the image.

• You may not use downloaded wallpapers as training data for machine learning or artificial intelligence models without explicit written permission from the creator.

When using Pixground, you agree not to:

• Violate any applicable local, national, or international law or regulation.

• Upload content that infringes intellectual property rights or violates our Community Guidelines.

• Use automated tools, bots, scrapers, or crawlers to access, collect, or index content from the platform without our written permission.

• Attempt to gain unauthorized access to other users' accounts, our servers, or our infrastructure.

• Interfere with or disrupt the platform, servers, or connected networks.

• Upload viruses, malware, or other malicious code.

• Engage in data mining, data harvesting, or data extraction activities.

• Circumvent any security measures, rate limits, or access controls.

Pixground reserves the right, but not the obligation, to:

• Review, edit, refuse, or remove any User Content at our sole discretion.

• Suspend, restrict, or terminate any user account for violations of these Terms.

• Report illegal activity to appropriate law enforcement authorities.

• Cooperate with legal processes, court orders, and government requests.

We strive to apply our policies consistently, but enforcement decisions are made at our sole discretion.

The Pixground platform, including its design, logo, trademarks, source code, and original content, is owned by Pixground and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any platform materials without our written permission.

Pixground may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third-party websites or services. Your use of third-party services is governed by their own terms and privacy policies.

Pixground is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The platform will be uninterrupted, secure, or error-free.

• Content on the platform will be accurate, complete, or current.

• Any defects will be corrected in a timely manner.

To the maximum extent permitted by applicable law, Pixground and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or goodwill, arising from your use of or inability to use the platform.

You agree to indemnify, defend, and hold harmless Pixground, its operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the platform, your User Content, or your violation of these Terms.

Pixground reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the platform.

You may stop using Pixground at any time. Pixground may suspend or terminate your access at any time, with or without cause, and with or without notice. Upon termination, your right to access the platform ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including ownership, warranty disclaimers, limitation of liability, and indemnification.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of laws principles. If you are a consumer residing in the European Union or United Kingdom, you also retain the protection of mandatory provisions of the law of your country of residence.

If a dispute cannot be resolved informally within 30 days, you and Pixground agree to submit the dispute to the competent courts of Berlin, Germany. If you are a consumer in the EU, you may also bring proceedings in the courts of your country of residence. For EU consumers, the European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.

To the maximum extent permitted by applicable law, you and Pixground each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found to be unenforceable in your jurisdiction, the remainder of these Terms remains in effect.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it will be severed. The remaining provisions of these Terms will continue in full force and effect.

These Terms, together with our Privacy Policy, Cookie Policy, Copyright Policy, and Community Guidelines, constitute the entire agreement between you and Pixground regarding your use of the platform. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter of these Terms.

The failure of Pixground to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Pixground.

By creating an account or using Pixground, you consent to receive electronic communications from us, including service-related notices, security alerts, and administrative messages. You agree that any notices, agreements, or other communications that we send to you electronically satisfy any legal communication requirements, including that such communications be in writing.

You may not assign or transfer these Terms, or any rights or obligations under these Terms, without the prior written consent of Pixground. Pixground may assign these Terms without restriction. Any attempted assignment in violation of this section is void.
